TERMS & CONDITIONS

These Terms & Conditions apply to all purchases from Stone & Design Market USA LLC, whether made by individual homeowners or trade professionals such as contractors, designers, or resellers. Where applicable, we have included clarifying notes for each party.

CLAIMS

No claims can be made after installation. Please inspect your products upon delivery and prior to installation. Installing the material signifies acceptance.

INSTALLATION

• Use moisture-sensitive thin-set for white marble, limestone, and cement-based products to prevent staining or bleeding. Always use clean water and premium white thin-set.
• All customers: Open and inspect all boxes before installation. Dry-lay the material to verify consistency in shade and texture.
• For contractors: You are responsible for blending materials from multiple crates to ensure visual uniformity for your client.
• For homeowners: We strongly recommend reviewing and approving the layout before your installer begins setting the tile.
• Order extra material to cover cuts, waste, and selection. We suggest at least 10% for regular cuts and up to 30% for diagonal or complex layouts.
• Natural stone varies in color, veining, and texture. These variations are part of the beauty of natural stone and not considered defects.
• When ordering additional material later, we cannot guarantee exact shade match with your original order.
• Use grout release or sealer prior to grouting.
• A minimum 1/8″ joint is recommended for all installations to allow for expansion and contraction.
• Natural stone may include minor imperfections like pits or fill. These are inherent characteristics, not flaws.

NO WARRANTY OF COLOR

Our products are natural and handmade. Shade variation is expected and adds to the uniqueness. Stone & Design Market USA LLC shall not be liable for color differences between delivered tiles and showroom samples.

ACCEPTANCE

Questions about color, design, or quality must be raised before installation. Installation confirms acceptance. No claims or returns are accepted after installation. Issues must be reported within 30 days of delivery.

NO WARRANTY AS TO QUANTITY ESTIMATES

We do not guarantee quantity estimates. It is the buyer’s responsibility to verify square footage requirements and order appropriate amounts.

AVAILABILITY

All items are subject to availability at the time of shipping. If an item is unavailable, we will notify you and may offer an alternative.

TERMS: PAYMENT

• Prices may change without prior notice.
• All totals are subject to final confirmation by our office. You will be notified of any adjustments before your order is finalized.

EXCLUSION OF DAMAGES

We are not liable for any indirect, incidental, or consequential damages related to our products. No warranties are made regarding fitness for a particular purpose beyond standard product use.

NORMAL WEAR & GROUT

All tile products may show wear, crazing, or light scratches over time. Grout color should be chosen carefully. Grout release must be used to avoid staining.

SPECIAL OR CUSTOM ORDERS

• Special orders require a 50% deposit when placing the order.
• Balance is due once the order is ready, before shipping.
• Special or custom items are non-cancelable and non-returnable.

DELIVERY TERMS

• All deliveries are F.O.B. from our warehouse.
• We are not responsible for damage in transit. Please inspect your shipment immediately upon receipt.
• Damage claims must be submitted in writing to the carrier within 5 days, with a copy sent to us.
• For contractors/resellers: You are responsible for unloading and safe storage of materials at the job site or warehouse.
• For homeowners: We recommend arranging help for unloading, as delivery drivers typically do not bring materials inside.

SAMPLE SHIPMENTS

Sample charges apply per item. For orders exceeding 2 samples of the same product, additional packaging fees may apply. We are not responsible for breakage during shipping.

FORCE MAJEURE

Stone & Design Market USA LLC is not responsible for delays or cancellations caused by factors beyond our control (natural disasters, transportation issues, etc.). Delivery timelines may be adjusted accordingly.

ASSIGNMENT

This agreement may not be transferred by the customer without our written approval.

CONFLICT OF TERMS

In the event of conflicting documents, the terms in this agreement take precedence. Any changes must be made in writing and signed by both parties.
